MyChart is provided by Tallahassee Memorial HealthCare, Inc. (“TMH”) and its affiliated clinics and partners.

THESE MYCHART TERMS AND CONDITIONS OF USE (AGREEMENT) IS A LEGAL DOCUMENT. READ IT CAREFULLY. BY CLICKING “I AGREE” BELOW OR OTHERWISE USING THE SERVICE, YOU ARE (A) ACKNOWLEDGING THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND (B) AGREEING TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, CLICK “I DO NOT AGREE” AND YOU WILL NOT BE PERMITTED TO USE THE SERVICE.

Medical Information

Information on MyChart is provided "as is" without warranty of any kind and is meant for use only to support the patient's relationship with their current or future medical professional. User reliance on the material in MyChart is at your own risk. Please note the medical or health care information provided on MyChart is not a replacement for proper medical attention. Contact your clinic, your physician or 911 services immediately if you are suffering from urgent medical issues. The electronic record is the property of TMH and the information displayed in MyChart may not be the complete medical record. Contact TMH directly for official copies of your medical record or concerning discrepancies with the medical information listed in your record.

TMH places considerable emphasis on the privacy of patient information and their compliance with State and Federal Privacy Laws. MyChart is configured to be secure from unauthorized access, but TMH cannot be held responsible for:

  1. Absolute security of all electronic communication transmissions between patient and clinic;
  2. Unauthorized disclosure resulting from a user not logging out of an active session;
  3. Unauthorized disclosure resulting from a lost or stolen user ID and password;
  4. Unauthorized disclosure resulting from information printed by the user from MyChart;
  5. Unauthorized disclosure resulting from personal computer settings or installed software products that may compromise information security; or
  6. Similar events outside the substantial control of the Host Sites.

Appropriate Use

Access to the MyChart system is granted to users for the purpose of furthering their medical care. The Services may include functionality that allows you to: (a) participate in E-Visits or Video Visits; (b) exchange messages with your physician/provider and their staff; (c) view parts of your medical record; and (d) use other electronic features offered by Provider at Provider's discretion (hereinafter, “Services”). Use of the system unrelated to this purpose may result in the suspension or termination of access privileges. Improper activities include but are not limited to the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently canceled, and other activities that are deemed to cause a disruption to clinic operations in the sole discretion of the TMH.

The Service may offer links to related medical websites not managed by TMH. TMH does not endorse and has not verified the accuracy of the information in/on these websites, and you should not rely on any of the information found on d the websites for purposes of treatment or diagnosis. TMH is not responsible for the content or practices of any linked sites.

TMH attempts to provide timely responses to all electronic inquiries, but we cannot guarantee any response time. With respect to any electronic communications sent by you, we are only able to respond to such communications based on the information provided by you. If there is insufficient information provided, we will be unable to provide accurate and reliable services.

Proxy Access

Patients who are age 18 or older may grant MyChart account proxy access to another individual. Personal representatives and legal guardians may also request proxy access to the patient’s MyChart account. TMH reserves the right to revoke any proxy access at any time for any reason.

Text Message Notification (SMS messages)

  1. When you opt-in to the service, we will send you an SMS message to confirm your signup;
  2. MyChart will deliver SMS message to notify you of messages in MyChart and surgery updates;
  3. You can cancel the SMS service at any time. You can modify your Notifications by choosing email or Text from the Communication Preferences in MyChart. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  4. If at any time you forget what keywords are supported, just text "HELP" to the short code. After you send the SMS message "HELP" to us, we will respond with instructions on how to use our service as well as how to unsubscribe;
  5. Carriers are not liable for delayed or undelivered messages; and
  6. As always, message and data rates may apply for any messages sent to you from us and to us from you. The number of messages you receive will depend on the number of notifications you select and your engagement. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. For all questions about the services provided by this short code, you call 1-855-513-5513.

Other Terms

TMH shall not be liable for any damages suffered by the user or other third parties related to, directly or indirectly, the material and information contained in MyChart. TMH cannot guarantee access to the MyChart system at any particular time and is not liable for the user's inability to access or view the information contained on the site. By downloading or viewing the information on MyChart, the user agrees to hold TMH harmless and indemnify it against any damages, claims, or other claims asserted against TMH arising out of, or in any way connected with, the user's utilization of MyChart or the information contained therein.

This Agreement shall be governed by the laws of the State of Florida and any dispute arising hereunder must be submitted to the state or federal courts in and for Leon County, Florida. MyChart information and the logos, icons, and other marks shown or referenced within are reserved by TMH.

Sites are protected by copyright and trademark law. The user may not reproduce such information without the prior written consent of TMH. This Agreement contains the entire agreement between the parties with respect to the subject matter contained herein and it shall not be modified or amended except by signed written instrument. The terms of this Agreement may be changed at any time at the discretion of TMH and updated terms will be posted on the MyChart website for user access.

TMH TAKES NO RESPONSIBILITY FOR AND DISCLAIMS ANY AND ALL LIABILITY ARISING FROM ANY INACCURACIES OR DEFECTS IN SOFTWARE, COMMUNICATION LINES, VIRTUAL PRIVATE NETWORK, THE INTERNET OR YOUR INTERNET SERVICE PROVIDER (ISP), ACCESS SYSTEM, COMPUTER HARDWARE OR SOFTWARE, OR ANY OTHER SERVICE OR DEVICE USED TO ACCESS THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMTED TO, ANY WARRANTY OF MERCHANTABILITY, TITLE, ACCURACY OF CONTENT, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THE ACCURACY, RELIABILITY OR COMPLETENESS OF THE SERVICE, NOR DO WE WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, AVAILABLE, CURRENT, COMPLETE, ACCURATE, VIRUS-FREE OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TMH OR OUR DIRECTORS, OFFICERS, TRUSTEES, PHYSICIANS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR LOSSES ARISING OUT OF OR RELATING TO: (A) THIS AGREEMENT, INCLUDING ANY BREACH OF THIS AGREEMENT; (B) YOUR USE OR INABILITY TO USE THE SERVICE (INCLUDING ANY CONTENT); (C) ANY CONTENT; OR (D) ANY INTERRUPTION, INTRUSION, BREACH OF SECURITY, COMPUTER VIRUS OR OTHER MALICIOUS CODE. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABIITY IS BASED ON CONTRACT, NEGLIGENCE, PROFESSIONAL NEGLIGENCE, TORT, STRICT LIABILITY OR ANY OTHER BASIS OR LEGAL THEORY.
